5. Website content is not professional advice

5.1 The content on our website is provided for general information only. It is not intended to amount to professional surveying advice, valuation advice, structural advice, legal advice, financial advice, tax advice, planning advice, conservation advice, contractor advice or any other advice on which you should rely.

5.2 Property defects, risks and repair requirements are highly specific to the individual property, its age, construction, condition, location, history, alterations, maintenance, occupancy and limitations at the time of inspection. General website content cannot replace a site-specific inspection, formal report or professional instruction.

5.3 You should obtain formal professional advice before taking, or refraining from taking, action based on anything published on our website.

5.4 No part of our website should be interpreted as confirming the condition, value, suitability, safety, compliance, mortgageability, insurability or repair liability of any specific property.

5.5 Any examples, photographs, case studies, articles, blog posts, estimated costs, defect descriptions, technical explanations or service descriptions are provided for general illustration only. They should not be assumed to apply to your property or circumstances.

6. Quotations, enquiries and instructions

6.1 Any online enquiry form, quotation request, booking form, contact form, automated email, price guide or service description on our website is provided for general information and enquiry purposes only.

6.2 A quotation request submitted through the website does not create a binding contract, professional appointment or instruction.

6.3 A quotation issued by AMS SURVEYS is not an acceptance of an instruction unless and until any required Terms of Engagement have been issued, agreed and signed, payment requirements have been met, and AMS SURVEYS has confirmed acceptance of the instruction.

6.4 We reserve the right to decline an instruction, withdraw or amend a quotation, request further information, or recommend a different service where we consider this appropriate.

6.5 Any timescales shown on the website are indicative only unless expressly confirmed in writing as part of a specific instruction.

6.6 Where a service is subject to professional standards, inspection limitations, access limitations, third-party information, property-specific risks, statutory restrictions or specialist requirements, these will be governed by the relevant Terms of Engagement and scope of service.

7. Reports, reliance and third parties

7.1 Professional reports, survey reports, valuations, schedules, advice notes, specifications and other formal documents prepared by AMS SURVEYS are subject to the Terms of Engagement, scope, limitations and assumptions applying to that specific instruction.

7.2 Website content is not a substitute for a formal AMS SURVEYS report.

7.3 Unless expressly agreed in writing by AMS SURVEYS, no third party may rely on website content, service descriptions, marketing material, email communications, quotations or reports prepared for another client.

7.4 If a lender, purchaser, seller, landlord, tenant, solicitor, insurer, contractor, managing agent or other third party wishes to rely on an AMS SURVEYS report or advice, they must contact AMS SURVEYS directly. Separate terms, scope, limitations and fees may apply.

7.5 Sharing an AMS SURVEYS report with a third party does not, by itself, create a duty of care, contractual relationship or reliance agreement between AMS SURVEYS and that third party.

8. Accuracy of website information

8.1 We use reasonable care to keep the website accurate, up to date and useful, but we do not guarantee that all content will always be complete, current, accurate or free from errors.

8.2 Building standards, professional standards, legislation, guidance, market conditions, mortgage requirements, insurance requirements and best practice may change over time. Website content may not reflect the latest position at the time you read it.

8.3 We may update, amend, remove or replace website content at any time without notice.

8.4 You are responsible for checking whether information is suitable for your own circumstances before relying on it.

9. Privacy and personal information

9.1 Your privacy and personal information are important to us.

9.2 We process personal information in accordance with our Privacy & Cookie Policy, which explains what personal information we collect, how and why we use it, who we may share it with, how long we keep it, your rights and how to contact us.

9.3 Our Privacy & Cookie Policy also explains how cookies, analytics, advertising tags, tracking technologies and similar tools may be used on our website.

9.4 You should read our Privacy & Cookie Policy before submitting personal information through the website, requesting a quotation or instructing us to provide services.

10.1 If you submit information through our website, you confirm that the information is accurate, lawful and not misleading.

10.2 You must not submit information that infringes another person’s rights, contains unlawful material, contains malicious software, or is intended to damage, overload or interfere with our systems.

10.3 You are responsible for ensuring you have permission to provide any information, documents, photographs, plans, reports or personal data that you upload, send or otherwise make available to us.

10.4 Unless otherwise agreed in writing, information submitted through the website will be treated as an enquiry and not as a formal instruction.

12. AI systems, automated access and MCP

12.1 Our website may include publicly accessible structured information, metadata, files, feeds, llms.txt content, sitemap content or Model Context Protocol functionality to help search engines, AI systems and digital agents understand publicly available website content.

12.3 Automated access is permitted only where it is lawful, reasonable, does not overload or disrupt the website, does not bypass security or access controls, and does not misrepresent AMS SURVEYS or our content.

12.4 AI systems and automated tools must not present general website content as property-specific advice, a formal survey conclusion, a valuation, a professional opinion, or a statement made by AMS SURVEYS in relation to a particular property unless this has been expressly provided by AMS SURVEYS in a formal written instruction or report.

12.5 Nothing on the website gives permission for our content, branding, reports, images, staff details or business information to be used in a way that is misleading, unlawful, defamatory, infringing or damaging to AMS SURVEYS.

13. Third-party websites and links

13.1 Our website may contain links or references to third-party websites, services, platforms, professional bodies, regulators, guidance providers, payment providers, booking systems, map providers, review platforms, social media platforms or other external resources.

13.2 These links are provided for information and convenience only.

13.3 We do not control third-party websites and are not responsible for their content, accuracy, availability, security, privacy practices or terms of use.

13.4 The inclusion of a link does not mean that we endorse, approve or accept responsibility for the third-party website, organisation, product, service, advice or content.

13.5 Your use of a third-party website is at your own risk and may be governed by that third party’s own terms and policies.

14. Viruses and security

14.1 We do not guarantee that our website will be secure or free from bugs, viruses or harmful material.

14.2 You are responsible for using your own virus protection software and for ensuring your systems are secure.

14.3 You must not misuse our website by knowingly introducing viruses, malware, trojans, worms, logic bombs or other harmful material.

14.4 You must not attempt to gain unauthorised access to our website, the server on which it is hosted, or any server, computer, database or system connected to the website.

15. Our responsibility to you

15.1 Nothing in these Terms of Use excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

15.2 We are responsible for foreseeable loss or damage caused by our breach of these Terms of Use or our negligence, subject to the limitations set out in these Terms of Use.

15.3 We are not responsible for:

17.2 No other person has any right to enforce any part of these Terms of Use.

18. General

18.1 If any part of these Terms of Use is found to be invalid, unlawful or unenforceable, the remaining parts will continue in full force and effect.

18.2 If we do not enforce any right or provision of these Terms of Use, this does not mean we have waived that right or provision.

18.3 You may not assign, transfer or sub-contract your rights or obligations under these Terms of Use without our prior written consent.

18.4 We may transfer our rights and obligations under these Terms of Use where this does not materially affect your rights.
